Transactional & Litigation Counseling
•Advised and assisted in-house legal department of a large publicly-traded corporation on a wide variety of contract issues, including management, service and staffing contracts, independent contractor, advertising, sponsorship and non-compete agreements.
Administrative Litigation
•Represented business corporations before the Environmental Hearing Boards on matters relating to issues under the jurisdiction of the Pennsylvania Department of Environmental Protection and the Susquehanna River Basin Commission;
•Litigated Right-to-Know matters regarding information requests from local and state agencies;
•Participated in appeals of adverse Office of Open Records decisions at the Common Pleas and Commonwealth Court levels;
•Advocated on behalf of a gaming and horse racing concern in connection with litigated license application proceeding before the PA Harness Racing Commission, the PA Gaming Commission and the Commonwealth Court.
Regulatory and Public Utility Issues
•Advised regulated entities on safety requirements, power and service contracts and affiliated interest agreements;
•Represents public utilities before the Pennsylvania Public Utility Commission in applications for commencement and abandonment of service, tariff changes, extensions of territory and other matters;
•Served as first and second chair in litigation proceedings such as rate changes, formal complaint matters and commission investigations;
•Secured regulatory approval of mergers and acquisitions representing both utility acquirers and targets;
•Assists natural gas and electricity competitive providers to obtain licenses to operate in Pennsylvania;
•Successfully assisted regulated utilities in preparing and prosecuting rate relief requests;
•Obtained favorable result for clients in settlement negotiations and formal and informal mediation;
•Advise regulated entities on issues related to compliance with Public Utility Commission rules and regulations;
•Challenge and defend Public Utility Commission decisions on appeal to the Commonwealth and Supreme Court.
